I. SUMMARY OF CASE

 

Three journalists and a driver who worked with them were arrested in Bangladesh on 25th November 2002, and have been remanded to police custody for five days. Another journalist, earlier allegedly in hiding, has been arrested on 28th November. All the four journalists are now remanded to police custody and without access to lawyers, consular officials or family members.

 

Two of the journalists, Zaiba Naz Malik (33, British national), and Leopoldo Bruno Sorrentino (29, Italian national), reportedly working on a documentary commissioned by the 'Unreported World' series for the independent British television channel, Channel 4, were arrested on 25th November in Benapole, on the Bangladesh border with India.

 

Pricilla Raj (31, Bangladesh national), a freelance researcher and former journalist with two leading national Bangla dailies, who had acted as their interpreter for two days, and her rent-a-car driver, Misir Ali (Bangladesh national), were arrested on the same day at Goalondo in Rajbari District. Reportedly, Misir Ali has since turned state's witness, and been released on bail.

 

A fourth journalist, Saleem Samad (Bangladesh national), local correspondent of the international body, Reporters Without Borders, was also arrested on 28th November.

The authorities have confiscated films and other documents from the detainees. 

 

According to reports, the four persons detained were arrested for gathering information and video footage for a documentary about the political situation in Bangladesh. The documentary was commissioned by Channel 4 in the UK for its foreign affairs program, 'Unreported World' (previous programmes in this series have investigated the genocide of Muslims by the Hindu right in Gujarat ('Saffron Warriors', 27 July 2002)).

 

The detainees have been denied access to lawyers, consular officials and family members since they have been on remand. Although the Court ordered that such access be given, the authorities holding the journalists refused access to lawyers and consular officials.

 

The journalists are currently under interrogation by the so called Joint Interrogation Command, comprising of both police and army officials, specifically the Special Branch, the Criminal Investigation Department, the National Security Intelligence and the Defence Forces Intelligence.

At least two other journalists -- Sumi Khan, the correspondent of the Shaptahik 2000 in Chittagong, and Subhas Choudhury of Satkhira, have also been questioned for having allegedly had contact with the two foreign journalists.

 

Legal/Consular Support

 

A lawyer has been appointed by Channel Four to act for the journalists. Two national legal aid organisations, Ain o Salish Kendro (ASK) [the Legal Aid and Mediation Centre] and the Bangladesh Legal Aid and Services Trust (BLAST), are representing and providing legal support to Pricilla Raj.

 

Consular officials at the British High Commission and the Italian Embassy in Dhaka reportedly attended the court hearing but have not met the journalists since

II. DRISHTIPAT APPEAL

 

As Bangladeshis concerned with the protection of fundamental rights, Drishtipat members are joining voices with many others inside and beyond the country to express concern at the latest clampdown by our Government on press freedom. 

We feel it is extremely important for Drishtipat to speak out on this case:

 

  • We are concerned at the immediate issues of the loss of liberty of these persons, and the risk to their personal security as they remain in police custody without adequate access to lawyers or their families, and, in the case of the foreign journalists, to consular officials; 
  • We are also appalled at the continuing use of outdated and colonial laws -- such as those of sedition and criminal conspiracy -- to silence journalists.
  • Most critically, we need to challenge our Government's attempt to use this case to further restrict the space for operation of all those who continue to work inside Bangladesh in defence of fundamental human rights and freedoms.  It is the continuing questioning of the arbitrary use of power by such individuals -- in particular independent journalists -- that keeps us on the path to democracy.

We believe that by taking arbitrary actions to deny press liberty and infringe on the right to free expression, the Government of Bangladesh itself risks accomplishing exactly what it accuses these journalists of doing, that is “tarnishing the image of the nation”.  In a climate of escalating accusations regarding the presence of internationally wanted terrorists in Bangladesh, the Government of Bangladesh must refrain from blanket denials and instead allow free and fair journalism to confirm the validity of such claims.

  • In addition to the dangers faced by the foreign journalists, we recognise the increased threat to their security that each of the arrested Bangladeshis will face -- and beyond them other colleagues working to safeguard open, democratic debate and discourse in Bangladesh.

1.       Express concern for the safety of Zaiba Malik, Pricilla Raj, Saleem Samad and Bruno Sorrentino;

2.       Urge the authorities to ensure the persons detained in police custody are not subjected to torture or ill-treatment;

3.       Urge the authorities to allow them access to lawyers, family, consular officials and doctors;

4.       Urge the authorities to drop the charges against all these persons and to direct the immediate release of Malik, Raj, Sorrentino and Samad;

5.       Point out that infringing upon press freedoms only serve to tarnish our nation’s positive image as a liberal democracy, not improve it.
